This document set out the conditions wich govern the use of this Website (www.llevateandalucia.com) and purchase on it. The use by the consumer or user of our online shop implies the acceptance of these General Conditions of Purchase (hereinafter the Conditions) in the version published at the time of purchase. Llévate Andalucía reserves the right to unilaterally modify, at any time and without prior notice, the presentation, configuration and contents of this Website. It is therefore advisable to read these Conditions before closing your purchase. The purchase contract may be formalized in Spanish and English.
2. DELIVERY AREAS
We can ship to the entire European Union. If you want to make a purchase from outside Spain or Portugal, please contact us by E-mail (email@example.com), or WhatsApp (+34 607650539) to study in detail the shipping options and costs.
3. HOW TO ORDER
To place an order, you must follow the online purchase procedure until you pay for any of the alternatives offered. To do this, you must enter all the fields marked as mandatory. Please verify all information entered before making payment. The fields requested as mandatory have the unique purpose the correct tracking, deliver and invoicing of your order. We will ask you to authorize the submission of commercial information.
After the payment, you will receive by E-mail an Order Confirmation that we ask you to keep to correct any possible incidents. Please, check your Junk Mail box. Finally, we will notify you as soon as your order is delivered to the transport agency for delivery.
If you detect an error in your order after making the payment, please contact us as soon as possible through our E-mail (firstname.lastname@example.org), our phone or WhatsApp, +34 607 650 539 to solve it.
By placing an order through this Website, you declare you are over the age of 18 and legally capable of establishing a contract.
4. PRICES, TAXES AND INVOICING
Our prices may change without prior notice and at any time. However, in no case will these changes affect orders already confirmed by the Order Confirmation. Our prices are expressed in euros and include the current VAT rate, but not the shipping costs. You can check the general shipping costs applicable to your geographical area in the information table in point 8. The shipping costs will appear broken down in the summary of your purchase prior to the formalization of the payment.
Unless otherwise instructed, we understand that you agree to receive an electronic invoice. However, any request for a paper invoice will be duly processed.
For orders destined for the Canary Islands, Ceuta and Melilla, purchases are exempt form VAT, and the amount corresponding to this will be deducted from the final amount before the order is formalized through payment. However, you must pay tariffs, customs broker and taxes on consumption that generates your order. These expenses are paid atg the time that the order is received, not being include in the amount paid in the purchase process. You can check the expenses that will hace to pay in the transport agency or the corresponding Customs. In these areas, if the data of the person placing the order are different from the data of the recipient of the order, it will be necessary to provide the recipient´s ID card to avoid problems with delivery.
If you place an order as the final consumer from an EU country other than Spain, you are subject to payment of the VAT in force in Spain at the time of purchase.
5. ACCEPTED PAYMENT METHODS
Payment will be made at the end of the purchase process, and will be indispensable condition for its formalization. The choice of payment method will be made during the purchase process. No form of payment is accepted on delivery, such as cash on delivery or after delivery. The accepted methods of payment are:
- Debit or credit card;
- Bank transfer;
In case of improper or fraudulent charge on the debit or credit card, the User must contact us by telephone/WhatsApp (+34 607 650 539) or E-mail (email@example.com) as soon as possible to make the appropriate arrangements. Credit cards will be subject to cheks by the issuing entity, but if said entity does not authorize payment, we will not be able to formalize any contract with you.
All orders are sent with a gift packaging. If you wish, you can ask us to include a personalized dedication and to deliver it to a different address than the payer. These options must be indicated during the purchase process in the field REMARKS in the first two cases and in the fields enabled for this purpose in the case of a different deliver address.
In case of requiring specific packaging or documentation, our shipments will be according to the regulations of each country. If you incur an additional cost (such as a Certificate of Origin for instance) we will let you know before you make your conformity payment.
7. SHIPPING AND DELIVERY TIMES
The maximum delivery time for our orders is 30 days from the date or Order Confirmation. In areas with customs procedures (Canary Islands, Ceuta, Melilla and not UE countries), this period may be delayed due to administrative issues beyond our control. However, given the special nature of our pieces it is possible that in some cases we may not be able to meet this delivery time. In these cases, the User will be informed as soon as possible so that you can decide whether or not to keep your order. If you wish to keep it, you will be informed of the new delivery period, and if you wish to cancel it, we will fully refund the payment you have made for it whithout any delay and, in any case, within a maximum of 14 calendar days from the date you inform us of the cancellation of the order. The refund will be made by the same means of payment used by you unless you tell us otherwise.
If we have difficulties in proceeding with the delivery of the order, we will contact as soon as possible, preferably by telephone, and if this is not possible, by E-mail, to agree on another time and/or address for delivery. If it is still not possible to make the delivery, after 15 calendar days from our first written communication, and if we do not receive any instructions from the User, we will understand that you wish to withdraw from the contract and consider it finished. In this case, we refund the payment made by the User, including shipping costs (with the exception of additional costs resulting from your choice of a different delivery method than the least expensive method we offer and which are listed in point 8) without any delay and in any case within a maximum of 14 calendar days from the date on wich we consider the contract rescinded and you are notified of this in writing. Please note that the transportation back to our store derived from the resolution of the contract will have a cost in respect of transport costs, so we are entitled to pass this cost on and deduct it from the amount to be returned.
If you require a particularly urgent delivery before a certain time, please contact us. We will do our best to meet your needs and we will inform you in advance of the cost of the shipment for your acceptance.
The risks of the products will be at your charge from the moment of their delivery to you, or to a third party designated by you, outside the transport agency itself. However, in case the user is in charge of the transport, or the chosen carrier is not among those proposed by our company, the risk will be transmitted to the user with the delivery of the goods to the carrier, without prejudice to their rights against this.
Our shipments are entrusted to a courier service of our complete confidence. The average delivery time is 48-72 hours for mainlans Spain, Baleares and Portugal and 3-5 days for other zones.
8. COMPLAINTS FOR DAMAGE CAUSED DURING TRANSPORT
All our shipment are insured against breakage and loss. In case of loss, and in case your package is not traceable in a confirmed way by our transport agency, we will replace your order as soon as possible without any cost for you. We will inform you of this fact as soon as we are aware of it.
To complain for damages or breakages, please detail to the courier at the time of delivery any appreciable damage to the external packaging and take pictures before opening the package. Also, please, open the package as soon as possible to check the status of your order. If you notice damage or breakage, please take photos and send them to us along with your complaint by E-mail (firstname.lastname@example.org) or WhatsApp (+34 607 650 539) as soon as possible to inform the transport agency. In order for this breakage to be covered by our insurance, the agency must be informed within a maximum of 7 days from the delivery of your order, so please do not loss this deadline. We will replace the damage pieces as soon as possible at no cost to you.
9. UNIQUE PIECES
All the pieces offered in this online shop are unique pieces as they are handmade by artisans. Therefore, all the pieces have reasonable differences in their details, even if they have common characteristics such as colours, format, measures, materials used, qualities, etc. Those differences cannot be considered in any case as defects, but as a clear and evident sign of their handmade elaboration, which prevents the exact replication of our pieces. If you consider it convenient, we will be able to confirm if the piece you are receiving will be or not the same one whose photo is exposed in our online shop/Website, and we can, if you wish, send you photos for express agreement.
Some of our pieces are customizable, and can be adapted to the preferences or requirements of each user. If you do not find what you are looking for, or want to develop a special idea, please contact us. We will do our best to fit your needs. In this case, we inform you that personalized pieces are not subject to return.
10. RETURN POLICY
If you make your purchase as a final User, you (or a third party designated by you, other than the transpot company) have the right to cancel your purchase without any justification within 14 calendar days from the date of delivery of your order by our transport agency. In the event that the order is made up of different pieces and these are delivered at different times, the period of 14 days will begin to count from the delivery date of the last of the pieces that make up the order. To exercise the right of withdrawal, you must send us within this period a clear communication by postal mail (to Llévate Andalucía, Pza. Luis Cernuda, 1, 1º 4, 41008 Sevilla, España or by E-mail (to email@example.com). If you wish, you can use the WITHDRAWAL FORM which you will have to receive with your Order Confirmation.
In case of withdrawal, we will reimburse all payments received from you including shipping costs (except for additional costs resulting from your choice of a delivery method other than the least expensive method offered by us and contained in the table in point 8), without any undue delay and, in all cases, within a maximum of 14 calendar days from the date on which we are informed of your decision to withdraw the contract. We will make such reimbursement using the same method of payment employed by you in your purchase unless you instruct us otherwise.
From those first 14 days, you have a maximum of 14 more calendar days to send us the refund. Only in this case will the withdrawal period be considered fulfilled. We may withhold the refund of the corresponding amount until we have received te return of the piece(s), or until you have provided evidence of its refund, depending on which condition is met first. You are responsible for the cost of returning the piece(s) to us. You shall only be liable for any diminished value of the goods resulting from handling other than necessary to establish their nature, characteristics and functioning.
You must be aware that if, once the order has been delivered, you decide to use your right of withdrawal and organise the return transport yourself, we cannot assume the risk on the delivery package when it referes to causes not attributable to Llévate Andalucía.
If the return is dued to a manufactoring defect or reception of wrong piece, you will have 14 calendar days to notify it, and you must indicate whether you wish to replace the piece by another with a similar or the same value (or higher paying the difference) or if you prefer a refund. If you chose to cancel the purchase definitively, we will refund the entire amount paid, including shipping costs, and we will coordinate the collection of the item, which must be returned in its origninal packaging through our usual agency and at no cost to you.
In accordance to current legislation, the return of customized products under User requesting will not be accepted.
11. WARRANTY PERIOD
If you contract as a User, and without prejudice of above right of withdrawal, we inform you that all our pieces have a two-year warranty from the date of delivery.
It is understood that our pieces are in accordance with the contract provided if:
- they conform to the description made and have the qualities that we indicate on our Website;
- they are suitable for the purposes for which products of the same type are normally intended;
- they have the quality and performance usually associated with a product of the same type that can be reasonably expected.
12. LIABILITY AND EXCLUSION OF LIABILITY
Except as otherwise expressly provided in these Conditions, our liability respect to any piece purchased from our Website shall be limited to the purchase price of that piece.
However, unless otherwise provided by law, we will not accept any liability for the followng losses, regardless of their origin:
- loss of income or sales;
- loss of business;
- loss of profit or loss of contracts;
- loss of anticipated savings;
- loss of data;
- loss of management time or office hours.
13. FORCE MAJEURE
Compliance by Llévate Andalucía in part or all of its obligations will be suspended in the event of force majeure that prevents or delays compliance. War, riots, insurrection, social unrest, nstural disasters, lockout, strikes and supply problems not attributable to Llévate Andalucía will be considered as such, and without this list being restrictive. We will inform you in these cases within seven days of their occurrence, In case that such a suspension is extended beyond a period of 15 days, you will have the possibility of cancelling the order in progress, and we will then proceed to its reimbursement under the conditions set out in pint 11 of these Conditions.
Our contractual obligations will be suspended during the period that the cause of force majeure continues, and we will have an extension of time to fulfil these obligations for a period equal to the duration of this force majeure.
14. RESOLUTION OF CONFLICTS
These Conditions are in accordance to Spanish legislation. For the conflict of interpretation and execution derived from the use of our Website, the Spanish legislation in force will be applicable and all conflicts will be submitted to Spanish courts.
We explicitly express our acceptance tgo undergo to Consumer Arbitration System in case the user requests it.
15. SUGGESTIONS AND COMPLAINTS
We will receive and attend any comments, suggestions or complaints from you. You can send them via postal mail (to Llévate Andalucía, Pza. Luis Cernuda, 1, 1º 4, 41008 Seville, Spain), via E-mail (to firstname.lastname@example.org) or via telephone/WhatsApp (to +34 607 650 539). We also have complaint sheets at your disposal. You can request them by any of the above-mentioned ways. Your compleint sheet will be dealt within 30 days at the latest. Complaint sheets will also be assigned a password that we will communicate to you and you should keep it for better track.
